State FE colleges (Scotland)


The trial licensing scheme for incorporated FE colleges in Scotland is effective annually and  runs from August to July each year. Licence terms and conditions and fees are agreed in negotiations with the ASC.

The current licence allows the following usage:

  • scan extracts from books, journals and periodicals (Licensed Material)

 

  • retype extracts from Licensed Material onto a computer

 

  • store copies on individual PCs or a networked server

 

  • incorporate digital copies into presentation software (e.g. PowerPoint™)

 

  • send copies by fax

 

  • email copies to Authorised Persons

 

  • use copies on a VLE / MLE / college intranet

 

  • receive Digital Copies supplied under other CLA licences

 

A discount is offered by CLA to colleges in membership of the ASC in recognition of their central negotiating, administrative and coordinating role. Each FE college has its own licence, which must be obtained directly from CLA.

Licence restrictions
Please note that there are some works that are excluded from all CLA licences and may not be copied in any form. These works are listed on the list of Excluded categories and works.

There are also some US publishers whose works are specifically excluded from all CLA licences. See the list of Excluded US publishers.

In addition please note that FE licences currently only permit the scanning of UK works only.

 

Trial Licence Background

In 2003 CLA introduced a trial blanket licence for the state FE sector offering scanning an rights in addition to the existing photocopying and acetate rights. This followed research into state FE colleges' use of copyright material. The trial is extended annually at present and is being reviewed by CLA and rightsholders.

 As part of this review, CLA commissioned Rightscom/IRN Research to carry out a study into the possible impact on primary sales into the FE market. A summary of the report findings can be downloaded from the link below.

Additionally, QI Statistics were invited to develop a framework for gathering data on scanning under the trial licence.
